But in this case its just a play on words, and is referring to the original site itself. And defamation is a subjective thing, he has the right to complaint about his experience as a customer. Anyway, I have absolutely no idea on who is right or wrong in this whole issue. But just a advice, this legal threats are very weak and is not going to help you get customers. I would be Insane if I paid thousands of rupees for a trademark which I don't protect. Not saying you have a shot with the 2nd case either, but the first is just a fools hope. Get this, if I insult a Microsoft because I had a situation with them, from which I was not satisfied, you think they can come and sue me? And like Noctis said, saying M$ or Xbot or something like that, would get me sued? Hell you cant even SUE someone who has used the same name, straight away. You need to inform them to change their name. If they still havent done it after a legal notice, only then can you proceed. However, your the one with the lawyer. Infringement may occur when one party, the "infringer", uses a trademark which is identical or confusingly similar to a trademark owned by another party, in relation to products or services which are identical or similar to the products or services which the registration covers. Here Jigsaw used con-soul to point to the exact same site and services, not create some other site called con-soul.in and try to confuse customers into thinking its the same.
