Other wise just gtfo Just cause it has a few legacy code from that engine doesn't means its a modified id Tech 3. If this is Id Tech 3 then GOW3 engine is a modified GOW1 engine, Brink is lightly modified Id Tech 4 and Farcry 2's Dunia is modified Cry Engine 1.....as all of them are built upon their previous iteration. Investing in a new engine requires time and funds, and according to them their current engine is already good enough to serve their purpose of making a decent looking game that targets 60FPS (you'd be lying if you say COD isn't 'among' the good looking games, cause its definitely among the top 10-15%). They make the highest selling tittles using the same engine which is criticized by so many people on internet boards, so if I were at a position to make decision then I'd ask what's the initiative for investing in development of a new engine? The series can easily make a significant jump in graphical quality by dropping he 60FPS target and aiming for double the rendering time ie. 30FPS, but then smooth control and fast response time is what makes COD so different from other shooters.
