I don't understand why the laws cannot be applied in retrospect ? Is this barred from the constitution or is it just the usual procedure followed ?

 

 

Criminal laws do not have retrospective effects. Dont know the technical reasons, but that is how it is, as per the Penal Code. Works the other way around too, like even though TADA has been repelled for a while now, sanjay dutt still got jail time in resonance with punishment under tada this year as he was booked under that act back in 90s when it was in effect.

 

Civil laws (like white collar crime) can/may have retrospective effects, depends on the decision taken during said law's drafting process. Like for example, GAAR will have retrospective effects if it materializes. That's why vodafone india is sh*ting bricks as it would then be taken to court over their alleged tax evasion of 2007-08.

Laws are not applicable retrospectively, cos laws are not constant, they keep changing with time and need of the country, for example the new Anti-Rape law that was brought in, now if that were to have retrospective effect that would cause a lot of changed sentences for people already serving their sentences which then opens a Pandora's box and the courts will be filled with cases that have already been dealt with according to the law that was applicable at that time, leaving room for a lot of manipulation and unnecessary litigation.

 

Plus it will lead to horizontal expansion of the legal system which needs to be as streamline as possible for it to be credible and fair. This expansion will in turn, open up huge space for lawyers to exploit and manipulate the laws according to the case at hand quoting judgements and drawing parallels to such cases of yesteryear's leading to a lot of overlapping judgements to a point wherein discretionary powers of Judge's will come out as a natural result which then erodes the credibility of judiciary as that shifts the focus from institution as a collective to the individual or person in question (the same as is being tried today in context of Indian politics), all this will ultimately result in people loosing faith on judiciary just as you are seeing it happen in case of politicos (fortunately Indian constitution allows repair job of Legislative branch every 5 years in the least whereas the same does not hold true for Judiciary, once the credibility of judiciary diminishes it will be next to impossible to repair or undo the damage), and therefore laws are not allowed retrospectively.

 

In layman sense it is the same reason why it is mandatory (in civilized countries) to drive in assigned lane (at least direction wise if not speed wise) this is why road dividers are built, so that people don't have the luxury to turn around and change direction at their whims & fancies which if allowed is most likely to cause accidents and huge traffic jams.

Only the non-necessary 'deemed' Government backed programs / utilities are being made dormant.

 

This has nothing to do with private sector Enterprises, unless they are in a partnership with said Public sector utility or are in an active contract with them.

 

Although this austerity will have repercussions for sure and only time will tell whether this was the right decision or no.

India lost 2K sq km land to China

 

Disclosing this, former special director of Intelligence Bureau R.N. Ravi said that internal assessment of Central agencies have estimated a loss of nearly 2000 sq km area of Indian territory to China.

Asserting that India has been following the policy of “living in denial” since the Nehru days, Ravi said that China has also succeeded in its objective of keeping its border with India undefined for strategic reason of capturing more Indian territory of its geopolitical interests.

Pointing out that China has transgressed over 10 km within Indian territory in the north sub-sector of the Western sector of the Indo-China border, Ravi said, “It has also escalated aggression in the eastern subsector along the tri-junction with Burma in Tatu Bowl-Dichu area in Anjaw district of Arunachal Pradesh.”

“Indians in Ladakh are also losing their economy due to aggression of China. This is what I have seen for myself in a recent visit this year to border villages of Ladakh. All these ground realities are kept under the carpet deliberately.” he added.

Can someone please explain what this Govt shutdown does in the US? Do everyday business run or are those also shut down?

 

Things like national parks and monuments close while the shutdown is in effect, processing times for certain government services (like passports, immigration etc.) may be affected because a good number of workers are furloughed.

 

Like Alpha said, private businesses aren't hit by this in the short term.

Cyclone Phailin: Superior preparedness could reduce casualties

 

NEW DELHI: If there was a silver lining in the grim foreboding of a monster storm, it's the realization that lives aren't that cheap in India any longer. For, the measures taken by the administration in the run-up to Cyclone Phailinto reduce casualties and minimize losses doesn't have parallels.

The superior preparedness and response this time for disaster is in sharp contrast to previous disastrous storms like the 1999 super cyclone. They are also in contrast with the Uttarakhand disaster when the state authorities were caught flat-footed. This time disaster management authorities are confident of meeting the challenge with minimal casualty.

 

The coastline has been dotted with cyclone shelters, none of them more than 2.5 km from habitation. This has ensured that over 5 lakh people could be evacuated in last two days. Otherwise, moving such large numbers could have been impossible.

 

Nothing has helped more than an early and accurate warning of the impending natural disaster. Though the met department did predict cyclones alerts even in 1999 based on satellite images, these were mostly too close to the landfall and not pinpointed in terms of location.

 

Today, there is a Doppler radar in place at Bhubaneswar, giving out precise coordinates in terms of geographical spread, intensity and timing of cyclones. This enables early alerts to the local authorities and wider dissemination of cyclone warnings in the vulnerable areas, facilitating timely evacuation of people likely to be affected.

 

The electronic media boom and 24x7 news coverage further ensured that Phailin became a household name well before its landfall.

 

Evacuations play a key part in disaster mitigation. Unlike 1999 when the super cyclone caught the victims as well as government authorities by surprise, around 5.25 lakh evacuations were already complete by the first half of Saturday.

 

The cyclone shelters have been built under the Centre and NDMA's National Cyclone Risk Mitigation Project, a World Bank-assisted initiative. These two-storeyed structures can withstand windspeed up to 300 km per hour and moderate earthquakes.

 

The massive evacuation authorities may not have been possible but for the relentless efforts of the local administration. A local official said when some of the villagers refused to leave their houses, the authorities even went to the extent of threatening them with detention and arrest, ensuring immediate compliance.

 

The creation of the National Disaster Response Force (NDRF) in 2006 ensured that there were around 2,300 personnel, especially trained in disaster mitigation and response, available for deployment, along with equipment like inflatable boads, lifebuoys and power saws.

 

Incidentally, Odisha had set up its own Odisha State Disaster Management Authority and Odisha Disaster Rapid Action Force (ODRAF) soon the 1999 disaster, much before the NDMA and NDRF came into being.

 

Last but not the least, the coordination between the Central and state agencies this time was "remarkably good", as an NDMA member put it, with IMD religiously relaying cyclone updates to NDMA, MHA and state government.

 

The national executive council, which was almost non-functional until the Uttarakhand disaster, has been very active, with the Union home secretary taking daily meetings over the last couple of days, coordinating mitigation and relief preparedness with various nodal ministries, Armed Forces, NDRF and state authorities.

Can't allow China to dominate India, we need to take ourselves seriously: Modi

 

 

BJP's prime ministerial candidate Narendra Modi Friday said India needs to take itself seriously on the world stage in matters of foreign policy if it intends to be taken seriously by the world.

Delivering the 11th Nani Palkhivala Memorial Lecture at the Madras University's Centenary Hall on the subject of 'India and the World', the Gujarat Chief Minister held forth on his views on foreign policy and stressed for a return to the foreign policy path laid down while Atal Bihari Vajpayee was PM.

"The immediate thing to do is take ourselves and our country seriously. There is no seriousness at all at present,'' Modi said during his talk held under a tight security blanket after the J Jayalalithaa-led AIADMK administration pulled out all stops to ensure the Chennai event went off without hitches.

"We cannot allow China to dominate India in foreign policy matters. We have been insensitive when we should have been sensitive. We remained weak when we needed to be strong,'' Narendra Modi told a packed hall where a small section cheered every word that he spoke.

Forget gold, go after black money: Narendra Modi

 

CHENNAI: BJP's prime ministerial candidate Narendra Modi on Friday took at dig at the UPA government for ordering the excavation around a medieval fort site in Unnao, Uttar Pradesh, for rumoured 1,000 tonnes of gold.

"The whole world is making fun of us. Someone dreamt of it and the Central government has gone hunting for 1,000 tonnes of gold. The black money of all the corrupt people is stored in Swiss banks, worth more than 1,000 tonnes of gold. They should first get that back," Modi told party cadres at Chennai airport on his arrival.

 

The Gujarat CM said if the Centre was capable of getting back black money stored in foreign banks, it would not have heaped humiliation on the country in the form of a gold hunt. He said a "cyclone of change" had gripped the nation. Alluding to cyclone Phailin which hit Odisha and Andhra Pradesh, Modi said it did not make much impact as the "cyclone for change" was already underway in the country. "People are dreaming of a Congress-free India, and Tamil Nadu, where BJP has little presence, was also part of this wave," he said.
